Terms and conditions of use thelma

The purpose of the present provisions is to define the conditions of access and use by the user (hereinafter referred to as the "user") of the thelma application (hereinafter referred to as the "application") managed by the competent customers (hereinafter referred to as the "Customer") and the Spallian company, publisher of the application (hereinafter referred to as "the company").

Presentation

The aim of thelma is to facilitate communication between citizens, the client and its various agents and/or service providers. The information provided by users is considered as working documents, which will help the client and its agents and/or service providers to organize and improve their actions. This information in no way commits the customer or its delegates and/or service providers to taking action within a given timeframe. The customer and its agents and/or service providers remain free to determine the actions to be taken, the relevance and reliability of the information provided, and the follow-up action to be taken.

The Customer and its agents and/or service providers accept no liability for any damage resulting from the use or interpretation of the information published on the application. The Customer and its agents and/or service providers are not in a position to guarantee the accuracy and completeness of this information, and therefore cannot be held liable on any grounds whatsoever for any errors contained in the application or for any direct or indirect damage that any person may suffer as a result of consulting the application or the information published on the application.

The Customer, its agents and/or service providers and SPALLIAN make every effort to ensure maximum and continuous availability of the application. In order to ensure quality service, SPALLIAN also reserves the right to carry out maintenance, updating or technical interventions during periods when access to the application services may be interrupted. However, the Company undertakes to limit the number and duration of service interruptions.

Registration

Registration to the application is required in order to access the application's services. Use of the application is not open to unregistered users.

Registration and access to thelma application services are free of charge and reserved exclusively for legal entities and natural persons of legal age and free of guardianship, who have validated the present general conditions of service.

The validation click at the end of the registration form validation process formalises the confirmation of the registration request and constitutes irrevocable acceptance of the present General Terms and Conditions of thelma service.

Registration is subject to the provision of a valid e-mail address and password. Once registered, the user will receive a confirmation e-mail with a link to click on in order to validate the registration.

The e-mail address can be changed by sending a request to customer support at: support@spallian.com

Optional identification elements (surname, first name, year of birth, gender) can be modified by the user from the application's "Settings" access, and are personal, confidential and non-transferable.

The Customer, its agents and/or service providers and SPALLIAN may not be held liable for any direct or indirect damage suffered by the user or by third parties, resulting from fraudulent access to the user's member access following disclosure of the user's personal identification data.

In particular, the Customer, its agents and/or service providers and SPALLIAN may not be held liable for any direct or indirect damage suffered as a result of access by unauthorized third parties to the user's member access, where such fraudulent access is based on the user's personal identification details.

Using the application

In order to communicate with the customer concerned, the user can use the application to send reports, suggestions or congratulations.

The user accepts that the data he/she has communicated may be published on the application, thelma.app website for online reporting and the service platform (back office), without any compensation being due.

As soon as a user communicates a report, suggestion or congratulations, he or she agrees to be put in contact with the city concerned or the nationally competent authority.

Users can send photos and comments to illustrate their reports, suggestions or congratulations.

By sending a feedback, suggestions or congratulations form, the user consents to the computerized processing of all data communicated on the form. This data may be used for communication purposes in connection with the processing of the file, and will not be used for direct or indirect marketing activities.

SPALLIAN, the Customer and its agents and/or service providers reserve the right, via a non-computerized moderation system, not to publish photos that are of insufficient technical quality, that have no connection with the subject of the entry, or that violate a legal rule. For example, photos of a racist, pornographic, violent, extremist or licentious nature, or which violate the privacy and/or image rights of third parties (see below) will not be published.

In the same way, the Customer and its agents and/or service providers or SPALLIAN will not publish comments that violate any legal rule, in particular those of a racist, pornographic, violent, extremist or licentious nature, or that violate privacy (e.g. citing the names of third parties).

The Customer and SPALLIAN reserve the right to ban any user who does not comply with the above rules.

The Customer and SPALLIAN cannot be held responsible for the content of photos and comments.

The user who communicates photos declares that they are free of rights and guarantees the Customer and its delegates and/or service providers and SPALLIAN against any recourse relating to the rights attached to the communicated photos.

Photos and comments must comply with the legal rules in force, and in particular respect trademark law (no misappropriation of trademarks, no advertising) as well as the privacy and image rights of individuals (no legible license plates, no recognizable faces of people who have not given their consent to publication of their image, no names).
